Terms of Service

1. Provider

Aigentably is operated by Ian Helmrich, Karolingerallee 9, 69181 Leimen, Germany (the “Provider”). Contact: info@aigentably.com. Full legal details are in the Impressum.

2. Service

Aigentably provides a hosted dashboard, embed script, and HTTP API that let you define WebMCP tools on websites you operate and have AI agents call those tools. The service includes a one-click Shopify integration that installs a curated set of storefront and Admin tools on connected Shopify stores.

3. Account and eligibility

You must be at least 18 years old or the age of majority in your jurisdiction. You are responsible for the security of your account credentials and for all activity under your account. You must provide accurate registration information.

4. Acceptable use

You agree not to:

• Use the service to violate any law or third-party right.
• Define tools that expose end-user personal data to AI agents without the lawful basis to do so under applicable privacy law.
• Send malicious payloads, attempt to disrupt the service, or probe for vulnerabilities outside a coordinated disclosure.
• Resell or sublicense the service except as permitted in writing.
• Use the AI tool-generation feature to produce content that infringes intellectual property or violates the underlying model providers' terms.

5. Shopify integration

By connecting a Shopify store you authorize Aigentably to install a theme app embed (or, on vintage themes, a reversible theme.liquid snippet) and to call the Shopify Admin API with the scopes shown during the OAuth flow. You may uninstall the app at any time from your Shopify admin; uninstall triggers deletion of all stored access tokens and shop metadata within 48 hours.

Merchant-facing billing for the Shopify integration is handled through Shopify's billing API and is subject to Shopify's terms in addition to these terms.

6. Fees and billing

Paid plans are billed monthly in advance. The Shopify plan is billed at $19 USD per monthafter a 14-day free trial via Shopify's merchant billing. Other plans are billed via Stripe at the prices shown at checkout. Fees are exclusive of any applicable VAT or other indirect taxes, which are added where required by law.

You may cancel at any time. Cancellation stops future renewals; fees already charged for the current billing period are non-refundable except where required by mandatory law. Statutory rights of withdrawal for consumers in the EU remain unaffected; the right of withdrawal expires once the service has been fully provided within a billing period with your prior consent.

7. Data protection

Processing of personal data is described in our Privacy Policy, which forms part of these terms. Where Aigentably processes personal data on your behalf as a processor under GDPR Art. 28, the Privacy Policy together with these terms constitute the data processing agreement; a separate signed DPA is available on request.

8. Suspension and termination

We may suspend or terminate your access with or without notice if you materially breach these terms, if your account is used for abuse or illegal activity, or if required by law. On termination we delete account data per the retention rules in the Privacy Policy.

9. Warranties

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all implied warranties, including fitness for a particular purpose and non-infringement. Mandatory consumer warranty rights under German law remain unaffected.

10. Liability

The Provider is liable without limitation for damages caused by intent or gross negligence, for damages from injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).

For damages caused by simple negligence the Provider is liable only for breach of a material contractual obligation (one whose fulfilment is essential for proper performance of the contract and on whose fulfilment you regularly rely). Such liability is limited to damages typical for this type of contract and reasonably foreseeable at the time of conclusion.

Any further liability is excluded.

11. Changes to the terms

We may amend these terms with at least 30 days' prior notice by email to active account holders. If you do not agree to an amendment you may terminate your account before it takes effect; continued use after the effective date constitutes acceptance.

12. Governing law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection law of the country of your habitual residence remains unaffected.

13. Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
